Terms of Service

These Terms of Service ("Terms") govern your access to and use of the VIGR website, mobile application, and related services (the "Services"). By creating an account, joining the waitlist, or otherwise using the Services, you agree to these Terms. If you do not agree, do not use the Services. These Terms are also the Terms of Use (end-user license agreement) for the VIGR iOS app.

1. Eligibility & accounts

You must be at least 16 years old (or the age of digital consent in your country) to use VIGR. You agree to provide accurate information, keep your credentials secure, and be responsible for all activity under your account.

2. The Services

VIGR provides wellness and performance insights based on data you log or sync from supported devices. The Services are for general fitness and lifestyle use only. See our Medical Disclaimer for important limitations.

3. Subscriptions, trial & billing

• Free trial: new users may start with a 14-day free trial of a paid plan. You will not be charged during the trial. If you do not cancel before the trial ends, your subscription automatically converts to a paid plan and your payment method is charged.
• Plans: VIGR Basic is $10/month, VIGR Pro is $15/month, and VIGR Premium is $20/month. Prices are shown in your local currency at checkout and may vary by region and applicable taxes.
• Billing: subscriptions are billed in advance on a recurring basis through the Apple App Store, Google Play, or Stripe, depending on where you signed up.
• Renewals & cancellation: subscriptions renew automatically until cancelled. You can cancel anytime from your account settings or the relevant app store; your plan remains active until the end of the current billing period.
• Refunds: except where required by law, payments are non-refundable. Store-initiated refunds are subject to Apple's and Google's policies.

4. Acceptable use

You agree not to:

• Use the Services for any unlawful, harmful, or fraudulent purpose.
• Reverse engineer, scrape, or interfere with the Services or any related systems.
• Upload content that infringes others' rights, is harmful, or is misleading.
• Share, resell, or sublicense your account, or use it on behalf of anyone else without permission.

5. Community content and conduct

Parts of VIGR let you interact with other people: friend requests, challenges, squads, shared routines and reports, arena messages, and, when enabled, chat. Anything you write or share there — including your display name, username, squad name, and messages — is user-generated content that other people will see.

We have no tolerance for objectionable content or abusive users. You must not post, send, or use as a name anything that is harassing, threatening, hateful or discriminatory, sexually explicit, violent, illegal, deceptive, spam, or that impersonates another person or promotes self-harm. You must not use VIGR to contact someone who has blocked you or who has asked you to stop.

Tools you have. You can block any user from their profile; a blocked user cannot send you friend requests, challenges, shares, messages or squad invites, and any friendship between you is removed. You can report any user or piece of content from the same menu. Reports go to our team at support@vigr.app.

What we do. We review reports within 24 hours. We may remove or edit content, reset names, restrict features, or suspend or terminate accounts, with or without notice, at our sole discretion, when we believe these Terms have been breached. Names and messages are also screened automatically for prohibited words, and an entry that fails screening will be rejected. We may preserve and disclose content and account information when we reasonably believe it is required by law or necessary to protect the safety of our users.

Your responsibility. You are solely responsible for what you post and for your interactions with other users. VIGR does not endorse and is not responsible for user-generated content. If you see something that breaks these rules, report it rather than engage.

6. Your content & data

You retain ownership of the personal and health data you submit to VIGR. You grant us a limited, non-exclusive license to host, process, and display that data solely to provide and improve the Services, as described in our Privacy Policy.

7. Intellectual property

The VIGR app, website, brand, logos, copy, designs, and underlying software are owned by VIGR and protected by intellectual-property laws. We grant you a personal, non-transferable, revocable license to use the Services for their intended purpose. All rights not expressly granted are reserved.

8. Third-party services

The Services may integrate with third-party platforms (such as Apple Health, Google Fit, wearable manufacturers, payment processors, and analytics providers). Your use of those services is governed by their own terms and privacy policies. We are not responsible for third-party services.

9. Disclaimers

The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. VIGR does not warrant that the Services will be uninterrupted, error-free, or that any insight will be accurate for your specific circumstances.

10. Not medical advice

VIGR is a wellness and fitness product. It is not a medical device and does not diagnose, treat, cure, or prevent any disease or condition. Always consult a qualified healthcare professional before making decisions about your health. See the Medical Disclaimer for more.

11. Limitation of liability

To the maximum extent permitted by law, VIGR and its officers, employees, and partners will not be liable for any indirect, incidental, consequential, special, or punitive damages, or for any loss of profits, data, or goodwill arising from or related to your use of the Services. Our aggregate liability for any claim relating to the Services will not exceed the greater of (a) the amount you paid us in the 12 months before the event giving rise to the claim and (b) USD 100.

12. Termination

You may stop using the Services and cancel your subscription at any time. We may suspend or terminate your access if you breach these Terms or to protect the Services or other users. Sections that by their nature should survive (e.g., IP, disclaimers, liability) will survive termination.

13. Changes to the Services or Terms

We may update the Services and these Terms from time to time. Material changes will be communicated through the app or by email. Your continued use after changes take effect constitutes acceptance of the updated Terms.

14. Governing law

These Terms are governed by the laws applicable at VIGR's principal place of business, without regard to conflict-of-laws principles. Mandatory consumer-protection laws in your country of residence still apply.
